1. Scope of Application

These Terms and Conditions apply to all contracts for products and services purchased via our online shop at https://www.energy-and-soul.com.

They apply equally to consumers and business customers unless expressly stated otherwise.

Our offerings include:

  • Digital products: e-books, meditations, online courses

  • Print-on-demand products: books, art prints, affirmation cards

  • Services: energetic coaching, workshops, trainings

2. Contract Formation

  1. The presentation of products on our website does not constitute a legally binding offer. By completing the order process, you submit a binding offer to purchase.

  2. The contract is concluded when we:

    • Confirm acceptance in text form (e-mail),

    • Deliver the goods, or

    • Request payment.

  3. An automatic order confirmation does not constitute acceptance.

  4. The contract text will be stored and sent to you by e-mail after the order is completed.

  5. Minimum age for purchases is 18 years.

  6. You are responsible for providing a correct e-mail address and ensuring that you can receive our messages.

3. Right of Withdrawal & Exclusions

Consumers within the EU have a statutory right of withdrawal of 14 days.
This right does not apply to:

  • Digital products, once you have expressly agreed that the download may start before the end of the withdrawal period (in accordance with §356(5) BGB),

  • Custom-made print-on-demand products,

  • Coaching/training services, once the service has begun.

Business customers do not have a statutory right of withdrawal.

Summary for You:

  • Digital content = No withdrawal after download starts

  • Print-on-demand = No withdrawal due to custom production

  • Coaching/training = No withdrawal once the service or full access to materials has begun

4. Prices & Payment Terms

  1. All prices are final. As our company is registered in the USA, no German VAT is shown.

  2. Accepted payment methods: prepayment, PayPal, credit card, Apple Pay, Maestro, invoice (by arrangement). Available options are shown during checkout.

  3. Payment processing may be handled via Stripe (www.stripe.com).

  4. For deliveries outside the EU, additional charges (customs duties, transfer fees) may apply and are payable by the buyer.

  5. Shipping costs:

    • Physical products incur additional shipping costs depending on destination country.

    • Digital products are delivered electronically and are free of shipping charges.

  6. All physical products are produced to order via print-on-demand. Production and delivery times vary.

  7. In the event of price errors, we will inform you and ask whether you wish to proceed at the correct price or cancel the order.

  8. Prices at the time of order apply. Later price changes or promotions do not affect completed orders.

5. Delivery, Shipping & Customs

  1. Print-on-demand products: production time approx. 7–14 business days.

  2. Digital products: available for download after payment.

  3. Shipping costs are displayed during checkout.

  4. You are responsible for providing the correct delivery address and accepting delivery. Costs for failed deliveries due to incorrect information will be borne by you.

  5. Customs regulations apply to deliveries outside the EU; you are responsible for compliance.

  6. We reserve the right to withdraw from the contract in cases of force majeure or other delivery obstacles beyond our control.

6. Grant of Usage Rights

  1. When purchasing digital content, you are granted a non-exclusive, non-transferable, perpetual right for private use.

  2. Sharing, reproduction, or public use without our written consent is prohibited.

  3. Usage rights are granted only after full payment.

7. Retention of Title

All goods remain our property until full payment has been received. For digital products, the usage rights are granted only after payment.

8. Warranty

Statutory warranty rights apply. For custom-made products, returns are excluded except in the case of defects. Please report obvious defects or transport damage promptly to contact@energy-and-soul.com.

9. Special Notes on Digital Products & Services

  1. Digital products are provided electronically via download or access link after payment.

  2. You are responsible for having the technical means to access the content.

  3. No refunds for coaching/training once begun.

  4. No guarantee of specific outcomes from coaching, workshops, energetic sessions, or training.

  5. Our services are intended as self-help support and do not replace medical or psychotherapeutic treatment.

10. Liability

  1. We are fully liable for injury to life, body, and health caused by negligence or intent.

  2. For other damages, we are liable only for intent or gross negligence.

  3. For slight negligence, liability is limited to foreseeable, typical damages.

  4. Energy work is not a substitute for medical diagnosis or treatment.

  5. We do not make healing promises. Changes in life circumstances following our sessions are the responsibility of the client.

11. Data Protection

We collect and process personal data in accordance with applicable data protection laws. Please refer to our Privacy Policy for details.

12. Intellectual Property Rights

  1. All copyrights remain with us or the respective rights holder.

  2. You may not reproduce, distribute, or make the digital content publicly available without our explicit permission.

13. User Accounts

  1. You must provide accurate and complete information when creating an account.

  2. You are responsible for safeguarding your login details.

  3. We reserve the right to suspend or delete accounts in cases of misuse or violation of these Terms.

14. Governing Law & Dispute Resolution

  1. These Terms are governed by the laws of the United States, without prejudice to mandatory consumer protection laws in your country of residence.

  2. The European Commission provides an online dispute resolution platform at https://www.ec.europa.eu/consumers/odr.

  3. We are not obligated or willing to participate in dispute resolution before a consumer arbitration board.

15. Disclaimer – Spiritual & Energetic Services

All statements and information provided on our website, in our e-books, webinars, events, and personal sessions are of a purely spiritual nature and are accessed from non-physical dimensions. From the perspective of current mainstream science, these subtle levels are not recognized as existing and therefore have no recognized factual validity, even if they relate to physical or psychological aspects.

Our sessions, treatments, and coaching do not replace medical examination or treatment by a licensed healthcare provider. We do not provide medical diagnoses and make no promises of healing. Energy work may cause significant shifts in your life; you are solely responsible for any resulting consequences.

16. Final Provisions

  1. We do not sell products or services to minors.

  2. Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.

  3. Oral side agreements do not exist. Changes or additions require written form.
